The High Court has ordered Safaricom and the Central Bank of Kenya to suspend the reintroduction of charges for transactions between mobile money wallets and bank accounts.

The reintroduction was to take effect from January 2023.

Milimani law court Judge Mugure Thande issued the order following an application filed by one Moses Wafula.

The transaction charges were waived in March 2020 as part of Covid-19 emergency measures to help ease the cost of living.

However, CBK in a press release issued on December 6 said the new charges that were to take effect would be lower than the previous charges before the emergency measure.

“The revised maximum charges for transfers from bank accounts to mobile money wallets will be reduced by on average up to 61 per cent, and mobile money wallet to bank account by on average up to 47 per cent,” CBK said.

The order by Justice Thande will be in force until January 23 when the matter will be mentioned for further directions.

In the meantime, she said responses to the motion filed by Wafula should be done by January 20.

The petition relates to financial consumer rights with a focus on the area of payment services provided by Safaricom in the form of Lipa Na M-Pesa pay bill service.

Wafula argues that since M-Pesa pay bill services is an outsourced service to Safaricom, the latter has no authority to charge members of the public for a service offered to its contracting service recipients including banks.

“If the Banks continue riding on this M-Pesa pay bill infrastructure and the courts ultimately find the M-Pesa pay bill platform to be in contravention of the constitution, the impact will be higher; more funds from the public would have been lost and it may be a lot more difficult to task the banks to refund such funds collected from the public,” Wafula’s petition reads.

Wafula also reveals that he had filed an application on July 3, 2021, seeking to add Central Bank of Kenya, the CS for Treasury and the Competition Authority of Kenya as respondents in view of their regulatory duties over Safaricom’s M-PESA business.

However, the said application is yet to be ruled on. It has been pending since May 12 last year ‘due to the transfer of Justice Anthony Mrima.’

The three parties are currently listed as ‘intended respondents’ in the latest application before the court. Other respondents named are Safaricom and Attorney General.

Information Cabinet Secretary Eliud Owalo unveiled elements of the first smartphone made in Kenya on Tuesday, January 10.

The smartphones currently being produced at the Konza Technopolis factory in Malili, Machakos County will have fully loaded Android capability.

Investors claim Tesla CEO’s tweets on the platform hurt the company and misled its 95 million followers and the public. The tweets in question included Musk announcing that he would shelve the offer, citing fake accounts and bots.
One of the lawyers in the case told BBC that the investors had decided to sue as Musk was continuously disparaging the company he wants to buy for $44bn to renegotiate the purchase price”.

The lawsuit further says that the Tesla boss benefitted financially by delaying the disclosure of his actual stake on Twitter as well as his plans to join the company’s board.
Investors claimed Musk knew about the bots, but his tweets attempted to manipulate the Twitter stock market. The case went on to say that four days later, he doubled down on his accusations that “the Twitter deal cannot continue.”
A lawyer in the case told the BBC that the investors decided to sue because Musk kept devaluing the company he planned to buy for $44 billion to renegotiate the purchase price.

The lawsuit further alleges that the Tesla CEO gained a financial advantage by delaying disclosure of his actual involvement on Twitter and his plans to join the company’s board of directors.

Central Bank of Kenya (CBK) Pensions Chairman Dominic Mwenja said on Thursday, May 26 at the opening of the building in the presence of President Uhuru Kenyatta that the building was even in It was respected in China before it opened.

Located on Harambee Avenue in Nairobi, the skyscraper features two shining sky-blue glass towers facing opposite directions.

Talking about its design, Mwenja revealed that it was inspired by retirees in two different directions, and the goal of pensions is to provide retirees with permanent funding.

“The fund started developing the property as one of its assets more than 4 years ago to ensure CBK’s retirees can retire comfortably.“A lot of people ask me why both towers are leaning in opposite directions. The whole idea is to have two retirees, one going this way and the other going this way. In between, we have pension funds and CBK being the backbone and support for our retirees is a testament to how we see retirees,” he explained.

The skyscraper is a 27-story building with 6 basements, including office space and retail for private tenants.
